Regulations effective from April 1, 2026.
I. General provisions:
1. The akeratea.com store operates under the principles set out in these Regulations.
2. These Terms and Conditions define the rules for using the online store – www.akeratea.pl, and the manner of providing services electronically and sales conducted through the akeratea.com Online Store by Danuta Sokół-Frąckiewicz – AGAT with its registered office at Waniewo 11, 18-218 Sokoły. These include: placing orders for goods available in the online store, delivering ordered products to customers, paying for purchased goods, the right to cancel an order and withdraw from the contract, and the rules for submitting and processing complaints.
3. The administrator of the website www.akeratea.com is the company “Danuta Sokół-Frąckiewicz – AGAT” with its registered office at: Waniewo 11, 18-218 Sokoły, with the tax identification number: NIP 722-115-16-69 and the REGON number: 451106350.
4. The Administrator provides the following services via the Website: familiarization with the Administrator’s offer and sale of the Administrator’s products.
5. In matters not regulated in these Regulations, the following provisions shall apply:
5.1. Act on the provision of services by electronic means of 18 July 2002 (Journal of Laws No. 144, item 1204, as amended),
5.2. Act on Consumer Rights of 30 May 2014 (Journal of Laws of 2014, item 827),
5.3. Act on out-of-court resolution of consumer disputes of 23 September 2016 (Journal of Laws of 2016, item 1823),
5.4. The Civil Code of 23 April 1964 (Journal of Laws No. 16, item 93, as amended) and other relevant provisions of Polish law.
II. Definitions included in the regulations:
ADMINISTRATOR – the company “Danuta Sokół-Frąckiewicz – AGAT” with its registered office at: Waniewo 11, 18-218 Sokoły, with the tax identification number: NIP 722-115-16-69 and the REGON number: 451106350.
WORKING DAY – a day from Monday to Friday, excluding public holidays.
ORDER FORM – an interactive form available on the Website that allows the Customer or User to place an Order.
CUSTOMER – a Consumer (within the meaning of Art. 22(1) of the Civil Code) or an Entrepreneur (within the meaning of Art. 43(1) of the Civil Code) who places an order within the Store.
Terms and Conditions – this document;
CIVIL CODE – the Civil Code Act of 23 April 1964 (Journal of Laws of 1964, No. 16, item 93, as amended).
PRIVACY POLICY – a document specifying the provisions regarding the processing of personal data.
PRODUCT – a movable item available in the Online Store that is the subject of a Sales Agreement.
SERVICE – the website www.akeratea.com through which the Administrator sells products.
STORE – the Service Provider’s online store operating at www.akeratea.pl.
SELLER – Administrator.
ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the Store.
USER – a Consumer (within the meaning of Art. 22(1) of the Civil Code) or an Entrepreneur (within the meaning of Art. 43(1) of the Civil Code) without an Account on the Website, for whom services may be provided electronically in accordance with the Terms and Conditions and legal provisions, or with whom a Sales Agreement may be concluded.
SALES AGREEMENT – a distance contract concluded within the meaning of Art. 2(1) of the Consumer Rights Act on the Website between the Seller and the Customer or User, the subject of which is the sale of a Product.
CONSUMER RIGHTS ACT, ACT – the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827, as amended).
ORDER – a declaration of intent by the Customer or User, submitted via the Order Form, directly aimed at concluding a sales contract, specifying in particular the type and quantity of Products.
III. Information about products and placing an order – conclusion of a sales contract:
The akeratea.com store conducts retail and wholesale sales of products presented on the store’s website.
- The products offered in the Store are new, free from physical and legal defects, and have been legally introduced to the Polish market. The price displayed on the Store’s website is given in Polish zloty, includes tax, and excludes shipping costs. It is binding upon the customer’s order placement.
3. Adding a product to the cart initiates the use of the Order Form. The Order Form requires the Customer to provide their personal information. The Customer must read and accept the Terms and Conditions at the time of placing the Order before placing an Order.
4. To place an order, you must select one of the available payment methods in the Order Form, select one of the available delivery methods, read these Terms and Conditions and the Website’s Privacy Policy, and accept their provisions. The order is placed after completing the Order Form and clicking the “Confirm order” button.
5. Placing an order by the Customer constitutes a declaration of intent to enter into a sales contract with the Seller. After placing the Order, the Customer will receive an order confirmation via email. Confirmation of order acceptance constitutes the Seller’s declaration of conclusion of the sales contract.
6. The prices of the Products listed on the website www.akerateal.pl include VAT and are given in Polish zloty. They do not include shipping costs. Shipping costs depend on the delivery method chosen by the Customer and on the value and size of the order. The total cost of the order (i.e., the price of the goods together with shipping costs) is indicated in the shopping cart before placing the order. The website reserves the right to update prices, however, the Seller is bound by the price in effect at the time the order is placed. Price changes do not apply to orders placed before the price change is implemented.
7. If it is not possible to fulfill a portion of the order, the Seller may propose to the Customer to cancel the entire order or to cancel the portion that cannot be fulfilled within the specified timeframe, or to split the order and set a new delivery date for the portion that cannot be fulfilled within the originally scheduled timeframe. Alternatively, the Parties may agree to modify the order based on individual arrangements.
IV. Payment methods and terms:
1. A customer making a purchase on the store’s website can use one of the following payment methods:
payment by transfer to the Seller’s bank account: 87 1050 1823 1000 0092 3602 4528 Bank Śląski.
payment via Stripe.
2. If the Buyer chooses payment by bank transfer, the Buyer is obliged to make the payment within 7 calendar days from the date of conclusion of the Sales Agreement.
3. The Customer consents to the Seller issuing electronic receipts/invoices in the form of a PDF file and sending them to the e-mail address provided by the Customer/User.
V. Delivery cost, methods and times:
Delivery of the Order to the Customer is subject to payment, unless the Sales Agreement provides otherwise.
Product delivery costs are determined during the ordering process and depend on the choice of payment method and delivery method of the purchased product.
The delivery time of the Product consists of the time of completing the Product and the time of delivery of the Product by the carrier: The time of completing the Product, depending on the quantity of the purchased product and its type, is: for retail up to 7 days, for wholesale up to 14 days.
Delivery of the Product by the carrier takes place within the time declared by the carrier, i.e. from 1 to 5 business days (delivery takes place only on business days, excluding Saturdays, Sundays and public holidays).
Products purchased in the Store are shipped via courier.
VI. ODSTĄPENIE OD UMOWY
There are no returns on the purchase of food items offered on this website.
Therefore, we ask you to make thoughtful purchases.
VII. Complaints about goods:
This section of the Terms and Conditions sets out the rules for filing complaints.
1. The Seller is liable to the Customer, who is a Consumer, for non-conformity of the goods with the contract under the terms specified in Articles 43a–43g of the Consumer Rights Act. In other cases, the Seller is liable under the warranty for defects under the terms specified in Articles 556–576 of the Civil Code.
2. Complaints arising from a violation of the Customer’s rights guaranteed by law or under these Terms and Conditions should be sent to Danuta Sokół-Frąckiewicz – AGAT, Waniewo 11, 18-218 Sokoły or to the following address: ……………….
3. For the complaint to be considered, the Customer should send or deliver the Goods in question, attaching proof of purchase. The Goods should be delivered or sent to the address indicated in point 2 above.
4. The Seller undertakes to review each complaint within 14 days.
5. If the complaint contains any deficiencies, the Seller will request the Customer to supplement it as necessary immediately, but no later than 7 days from the date the Customer receives the request. The Seller will reimburse the Customer for shipping costs if the goods do not conform to the description. In other cases, the Buyer will bear the cost of returning the purchased goods.
8. If the complaint is considered in the Customer’s favor, the Seller will immediately replace the defective product with a defect-free one or remove the defect. If replacement, removal of the defect, or reduction of the price is not possible, the Company will refund the amount immediately in accordance with applicable law. If the complaint is deemed justified, the Seller will also reimburse the costs associated with returning the complained product to the Seller.
VIII. Personal data:
Detailed information on the processing of Customers’ personal data is included in the Privacy Policy.
IX. Final provisions:
The Seller reserves the right to amend the Terms and Conditions for important technical, legal, and/or organizational reasons. Amendments to the Terms and Conditions become effective within the time specified by the Company, which must be no less than 7 days from the date the amended Terms and Conditions are posted on the Online Store website www.akeratea.pl. Orders placed by Customers before the amendments to the Terms and Conditions take effect will be fulfilled in accordance with the existing provisions of the Terms and Conditions.
